  1. The Scheme & Prize Draw

The scheme and prize draw is called Win with SMS Prize Draw.  Simply complete the online form to be entered into the prize draw to win The Heritage Tea, Coffee & Treats Hamper from M&S, worth £55.

The scheme is open from the 13th June 2024 and will remain open until Friday 26th July 2024.

  1. How to Enter

To enter the Win with SMS prize-draw, simply complete the online form with your details.

You can be entered into the prize draw multiple times to increase your chance of winning.

By filling out the form you are agreeing to be contacted by Schools Mutual Services, using the contact details you have provided.

Schools Mutual Services will not accept responsibility for prize-draw entries that are lost, mislaid, damaged or delayed in transit, by any means, regardless of cause, including for example, as a result of online platform or internet failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

  1. Eligibility

You must have submitted the form with your correct contact details.

The prize draw is open to UK citizens over the age of 18 years old; except for;

  • employees of Schools Mutual Services Ltd or its holding or subsidiary companies;
  • employees of agents or suppliers of Schools Mutual Services Ltd or its holding or subsidiary companies, who are professionally connected with the scheme or its administration; or
  • members of the immediate families or households of (a) and (b) above.

In entering the scheme, you confirm that you are eligible to do so and eligible to claim the prize. Schools Mutual Services may require you to provide proof that you are eligible to enter the scheme.

Schools Mutual Services will not accept scheme entries that are:

  • automatically generated by computer;
  • completed by third parties or in bulk

Schools Mutual Services reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the scheme structure.

By submitting a scheme entry, you are agreeing to be bound by these terms and conditions.

The winner of the prize draw will be chosen by way of a random selection that will take place at a date and time to be confirmed by Schools Mutual Services Ltd.

  1. The Prize

The prizes are not negotiable or transferable or refundable and will be as defined at the time.

  1. Winner announcement

The winner of the prize draws will be announced on our website within a reasonable time following the random selection. There will only be one winner for each prize.

The decision of Schools Mutual Services is final and no correspondence or discussion will be entered into.

Schools Mutual Services will contact the winner personally as soon as practicable after the Announcement Date, using the contact details provided with the scheme entry. Schools Mutual Services will not amend any contact information once the scheme entry form has been submitted.

Schools Mutual Services may publish the name of winner on their website and social media.  

  1. Claiming the prize

Schools Mutual Services will make all reasonable efforts to contact the winner selected at random, on the date defined.  If the winner cannot be connected or is not available, or has not claimed their prize within 7 days of being contacted via telephone and email. Schools Mutual reserves the right to offer the prize to the next eligible entrant.

Schools Mutual Services does not accept any responsibility if you are not able to take up the prize.

  1. Limitation of liability

As permitted by law, Schools Mutual Services, its agents, or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury, or death occurring as a result of taking up the prize except where it is caused by the negligence of Schools Mutual Services, its agents or distributors or that of their employees. Your statutory rights are not affected.

  1. Data protection and publicity

If you are the winner of the prize draw, you agree that Schools Mutual Services may use your name, image and town or county of residence to announce the winner of the prize draw.

By entering the scheme, you agree that any personal information provided by you with the scheme entry may be held and used only by Schools Mutual Services or its agents and suppliers to administer the scheme.

Any personal data relating to the referred friend will be used solely in accordance with the current General Data Protection Regulation (GDPR) and will not be disclosed to a third party without the individual’s prior consent. Data relating to entrants will be retained by Schools Mutual Services for a reasonable period after the scheme closes to assist Schools Mutual Services to operate scheme in a consistent manner and to deal with any queries on the scheme.

  1. General

If there is any reason to believe that there has been a breach of these terms and conditions, Schools Mutual Services may, at its sole discretion, reserve the right to exclude you from participating in the scheme.

Schools Mutual Services reserves the right to hold void, suspend, cancel, or amend the prizes where it becomes necessary to do so.

These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.

  1. Ownership of scheme entries and intellectual property rights

All scheme entries and any accompanying material submitted to School Mutual Services Ltd will become the property of Schools Mutual Services Ltd.

By submitting your scheme entry and any accompanying material, you agree to:

  • assign to Schools Mutual Services all your intellectual property rights with full title guarantee; and
  • waive all moral rights, in and to your scheme entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

You agree that Schools Mutual Services may, but is not required to, make your entry available on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the scheme. You agree to grant Schools Mutual Services a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the scheme entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the scheme entry and any accompanying materials for such purposes.
